Resolution Concerning the 2012 National Defense Authorization Act

Whereas, the United States Congress recently passed, and President Barack Obama signed into law, the National Defense Authorization Act (NDAA) for calendar 2012 that continues to allow indefinite military detention without trial of American citizens based solely upon the discretion of the executive branch of the federal government and does not allow for the accused to have legal access, an administrative hearing, or notification to relatives or friends; and

Whereas, constitutional scholars across the political spectrum, including the ACLU, believe that the military detention provisions are unconstitutional and illegal, violating the 6th Amendment right to a speedy and public trial by an impartial jury of peers and numerous other inviolable rights; and

Whereas, our basic habeas corpus rights, dating back to the Magna Carta of 1215 and reaffirmed by the blood shed in the American Revolution, are violated by this law in disregard of our constitutionally guaranteed liberties.
Therefor be it resolved, that the Los Angeles County Democratic Pary calls for the immediate end to this violation of human rights and calls for our Congressional delegation to remove the offending provisions, and

Be it further resolved, that the Los Angeles County Democratic Party send a copy of this resolution to President Obama, the California Democratic Congressional Delegation, to Senators Feinstein and Boxer and the California Democratic Party.
