Resolution in Opposition to Bypassing the California Environmental Quality Act (CEQA)

WHEREAS, the California courts have held that most ballot measures are exempt from the California Environmental Quality Act (CEQA); additionally, the California Supreme Court has held that a project is not subject to CEQA if a City Council approves the project after a ballot measure in favor of the project has qualified for the ballot; and

WHEREAS, developers have already used ballot measures to approve projects without meeting CEQA requirements, and this process can compromise protection of the environment and adversely affect the quality of life in our communities;

THEREFORE BE IT RESOLVED, that the Los Angeles County Democratic Party urge the Legislature and Governor to eliminate loopholes in state law which can currently be exploited to allow projects to bypass the CEQA process; and

BE IT FURTHER RESOLVED, that the Los Angeles County Democratic Party will send this resolution to the Governor, Senate President Pro Tem, Speaker of the State Assembly and Lead Chairs of the California Democratic Party Resolutions Committee.
