#TrumpCheck - The Lies in the Courts

Happy Wednesday! Welcome back to our #TrumpCheck series, the LACDP's weekly newsletter that holds the Trump administration accountable for its lies, deception, and self-serving actions. We took last week off for an early Memorial Day (and a pre-JFK Awards) break, and it's good to be back. 

Fights between Trump and his boss-turned-BFF-turned-critic Elon Musk are making headlines this week. The two are arguing back and forth about Trump's legislative agenda, which he refers to as the "Big, Beautiful Bill," as it is approved by the House of Representatives

So, while the GOP fights about their ugly little bill, we are here today to address items being buried in the news cycle: Trump's ongoing battles in the courts. As of today, May 28, 2025, over 180 lawsuits against the Trump administration have halted the government's agenda. Within these legal battles are dozens of lies being spread by his MAGA cronies, which we are here today to debunk. 

FACT: Habeas corpus serves as a safeguard against the unlawful imprisonment of individuals. This legal procedure allows the court to review the legality of an individual's detention to ensure that someone is not being held without due process. Contrary to what Secretary Noem stated, the suspension of habeas corpus has never been done without the approval of Congress

  • During a court hearing, DOJ attorney Abhishek Kamblani tried to protect both Trump and DHS Secretary Noem from liability regarding statements that the two made about the Trump administration's efforts to return Mr. Kilmar Abrego Garcia to the United States.
FACT: In an interview with ABC, Trump said he could simply call the President of El Salvador and get Mr. Abrego Garcia back. Kristi Noem has also stated that the CECOT prison is a "tool that will be used by the U.S." to stop illegal immigration. Kamblani directly contradicted Secretary Noem and President Trump while trying to defend their statements. 
FACT: Newly released footage from Columbia University shows Mahmoud Khalil cooperating, handing his phone to officers to speak to his attorney, handing his Green Card to the agents, and even telling them, "Yes, I'm coming with you," giving no indication of being a flight risk. 

While Trump and his attorneys try to get their facts straight, we will continue to debunk their lies. It takes all of us to fight the blatant mistruths that Trump's folks are spreading in our courts and on the Internet. The first step in fighting back against the Trump administration is setting the record straight; correcting misinformation is a job for us all.
